Agricultural Product Disclaimer
Heritage Meadows Farm LLC sells agricultural and livestock-related products, including hatching eggs, poultry, and farm goods that involve inherent biological variability and risk.
By purchasing from Heritage Meadows Farm LLC, You acknowledge and accept that outcomes involving fertility, hatch rates, growth, health, development, and performance may vary and cannot be guaranteed.
All products are sold AS-IS unless otherwise stated in writing.
Order Acceptance and Refusal
We reserve the right to refuse, limit, cancel, or decline any order at Our sole discretion for any reason including but not limited to:
Product availability
Biosecurity concerns
Weather conditions
Shipping concerns
Suspected fraud
Abuse toward staff
Excessive refund demands
Previous chargebacks or disputes
Violation of these Terms
Cancellation Policy
Orders may only be cancelled prior to shipment.
Cancellation requests are reviewed individually and approval is solely at the discretion of Heritage Meadows Farm LLC.
Refunds for cancelled orders prior to shipment may be approved in cases involving substantial hardship circumstances including but not limited to:
Death in the family
Serious illness
Disability
Emergency situations
Approved cancellations may still be subject to:
Payment processing fees
Administrative fees
Non-refundable deposits
Custom packing or handling expenses already incurred
Once an order has shipped, it cannot be cancelled.
Hatching Egg Sales Policy
Hatching eggs are sold with the understanding that shipping and incubation involve significant variables beyond Our control.
We cannot guarantee:
Hatch rates
Fertility percentages
Live hatch counts
Chick quality after hatch
Incubation success
Shipping carrier handling
Delivery times
Customer incubation practices
Many factors impact hatch success after shipment including but not limited to:
Rough postal handling
Temperature fluctuation
Humidity fluctuation
Delayed delivery
X-ray exposure
Improper storage
Incubator calibration
Turning schedules
Sanitation practices
Power interruptions
Altitude
User experience
By purchasing hatching eggs, You acknowledge these risks and accept full responsibility for incubation outcomes after delivery.
No Refund Policy for Shipped Hatching Eggs
ALL SALES OF SHIPPED HATCHING EGGS ARE FINAL.
No refunds will be issued after shipment for any reason including but not limited to:
Low hatch rates
Infertility claims
Embryo death
Failure to hatch
Incubation errors
Incubator malfunction
Delayed shipment
Mishandling by postal carriers
Customer dissatisfaction with hatch outcome
Once the customer begins incubation, all responsibility transfers entirely to the customer.
Incubation of hatching eggs is a biological process entirely outside of Our control after delivery.
Purchasing hatching eggs is comparable to purchasing raw food products: the final outcome depends heavily on handling, preparation, equipment, and environmental conditions after purchase.
Damaged Egg Replacement Policy
If eggs arrive physically damaged during shipment, We will provide replacement eggs on a one-for-one basis for verified damaged eggs only.
To qualify for replacement:
Claims must be submitted within 12 hours of delivery confirmation
Clear photographs of:
Damaged eggs
Internal packaging
External shipping box
Shipping label
must be provided
Claims must be submitted before incubation begins
Replacement eligibility applies only to eggs physically broken or visibly damaged during transit.
Hairline cracks, detached air cells, reduced hatchability, or poor hatch rates are not considered shipping damage.
We reserve the right to deny claims lacking sufficient documentation.
Replacement shipments are subject to product availability and appropriate shipping conditions.
No monetary refunds are guaranteed for damaged shipments.
Shipping and Carrier Liability
Once a shipment is transferred to the carrier, shipping timelines and handling are outside of Our direct control.
We are not responsible for:
Postal delays
Lost packages
Mishandling by carriers
Weather-related shipping interruptions
Carrier scanning errors
Heat or cold exposure during transit
Customers accept the risks associated with shipping live agricultural products and hatching eggs through commercial carriers.
Biosecurity and Animal Health
For the protection of Our flock and farm operations, Heritage Meadows Farm LLC reserves the right to delay, refuse, or cancel shipments due to:
Disease concerns
Biosecurity risks
Extreme weather
Breeding interruptions
Flock health management
Animal and agricultural product availability may vary seasonally and biologically.
Chargebacks and Fraudulent Claims
Customers initiating fraudulent payment disputes, chargebacks, false damage claims, harassment, or abusive refund behavior may be permanently refused future service.
We reserve the right to provide shipment records, photographs, communication history, tracking information, and these Terms and Conditions to payment processors or financial institutions in defense of disputed transactions.
Limitation of Liability
To the fullest extent permitted by law, Heritage Meadows Farm LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
Purchase of Goods
Shipment delays
Hatch failure
Fertility issues
Livestock loss
Incubation outcomes
Product misuse
Agricultural variability
Any liability shall be strictly limited to replacement of verified physically damaged eggs as outlined in these Terms.
